Alternative Dispute Resolution

Mediation, Arbitration and Negotiation have come to be accepted as Alternative Dispute Resolution - alternative to the public forum of open trial which has characterized American jurisprudence. Through an interactive examination of the forms, costs and benefits, strengths and weaknesses of these and other non-trial processes, this class will explore their role, in conjunction with traditional litigation, in providing the opportunity for Appropriate Dispute Resolution, and their implications for the lawyer/client relationship. The final grade will have a class participation component, based on performance in simulation exercises.
