Law School Hosts Missouri Court of Appeals Special Session

The law school recently hosted a Special Session of the Missouri Court of Appeals, Eastern District. Attorneys for three casesinvolving strict liability, contract law, and criminal procedure―argued their sides before Chief Judge Roy. L. Richter, Judge Kathianne Knaup Crane, and Judge Sherri B. Sullivan. A Q&A on judicial procedure and an informal Q&A on judicial clerkships followed the session.

The cases centered on the:

  • strict liability of the owners of three dogs that allegedly killed 21 deer that were part of a breeding operation. The case hinges on whether the deer should be considered “domesticated animals” under §273.020, RSMo, and whether the dogs involved in the attack were clearly identifiable;
  • breach of contract in a real estate deal, including application of the parol evidence rule in contract law; and
  • appellant’s motions for mistrial, judgment of acquittal, and suppression of evidence related to his convictions for first-degree murder, first-degree assault, and armed criminal action. The case hinges on the defendant’s right to due process, admission of evidence related to the defendant’s alleged gang affiliations, and the prosecution’s reference during closing arguments to the defendant’s failure to testify.
