Topic: Guantanamo: Learning from the Past to Confront the Future

President Obama has ordered the closure of the U.S. detention center at Guantanamo Bay by January 2010. Yet, key issues surrounding the fate of the men and of U.S. detention policy generally have not been resolved.  This lecture provides an overview of key lessons learned from Guantanamo after nearly eight years of intensive battles in the courts and in Congress.

Will the United States…

  • Continue holding terrorist suspects indefinitely without charge?
  • Continue using military commissions rather than civilian courts?

What about prisoners...

  • Held “beyond”Guantanamo, such as the U.S. detention center at Bagram Air Base in Afghanistan?
  • Will they continue to be denied access to U.S. courts?
