INSTRUCTIONS:

      1. This is a three hour closed book examination.

      2. The examination contains two essay questions. Although the times are approximate, you should plan to allocate about 2 hours to Question I and about 1 hour to Question II. Be sure to allocate your time so you finish the entire exam.

      3. Each question is divided into three parts: Part A, Part B, and Part C. Each part has one or more numbered questions. Please begin the answers to each part of Questions I and II on a new page that is clearly identified as Part A, Part B, or Part C at the top of the page. Answer the parts and questions in order using the numbering system provided in the exam.

      4. If you are typing your exam, begin the answer to Question II on a new page after the answer to Question I and mark it clearly as Question II.

      If you are handwriting your exam, answer Questions I and II in separate exam books. Mark the outside cover of each book as "Question I" or "Question II." Be sure to write your exam number on the cover of each book.

      5. Read the facts and the questions at the end of the facts carefully. Some, but not all, of the questions will call for analysis of the issues under both the Common Law and the Model Penal Code. Be sure to follow the instructions in each question.

      6. Your grade will be based on your analysis of the legal issues raised by the facts and your responsiveness to the questions asked at the end of the statement of facts. Clarity, conciseness, and organization are important, but be sure that your answer includes all relevant steps in your reasoning.

      7. You will receive credit only for your essay answers. Credit will not be given for notes or outlines.

      8. If you are handwriting your exam, please write legibly on every other line of the page and write on only one side of each page. Please do not write in pencil.
